Welcome to Servers Gate Terms of Service agreement! This document is available to protect both you and us. By using our services, you agree to our Terms of Service agreement.
This Terms of Service (TOS) is the contract between Servers Gate and the individual or company, corporation to whom we are providing services
These Terms of Service govern the relationship between you (referred as “customer”) and Servers Gate. Each customer is subject to these Terms, and by using Servers Gate services, network and services customer agrees to be bound by the usage policies and other policies contained in these Terms.
Customer represents and warrants that, if an individual, customer is at least 18 years old, or, if an entity, customer is a corporation, limited liability company, partnership, or other legal entity duly formed and in good standing where required to do business with all legal authority and power to accept these Terms. Customer agrees to provide complete, accurate and current information to Servers Gate in connection with all registration or renewal processes and further agrees to update all such information as necessary to maintain complete, accurate and current information. Although customer of paid services offered through Servers Gate must be at least 18 years of age, a parent or legal guardian of a minor may obtain an account on the minor's behalf, and by doing so, consents to such minor’s use of the Services. Subscribing parents and legal guardians assume full responsibility and liability associated with a minor's use of any of the Services.
Rules of Behavior
As a condition of use, you have to promise not to use the Services for any purpose that is prohibited by these Terms of Service or LAW. You are responsible for all of your activity in connection with the Services and the activity of any sub-user that uses your account.
Cancellation Of Services
The customer may cancel their services at any time from the Client area.
Security
Servers Gate uses sophisticated means of security in connection with the Services. Servers Gate will not be liable for any loss or damages of any kind, under any legal principle.
Domain Agreement
Servers Gate may register top level domain name for customers as requested by them all those domains are backed with terms of their respective registrars & ICANN policies.
Spam Policy
Servers Gate servers may not be the source or intermediary involved in the transmission of Spam, Spamware and other Spam Software or misuse of SMTP. Client's domain or IP may not be referenced as originator or intermediary in any of the above.
Servers Gate considers Spam to be any mass unsolicited message in the mediums of newsgroups and e-mail.
The actions stated above will not be tolerated. Violation will result in the immediate deactivation of services without refund of any kind. Servers Gate is the sole arbiter as to what constitutes a violation of the above provisions.
Abuse Complaints
All abuse complaints must be responded to no later than 12 hours after the complaint is made. Failure to reply may result in account termination. Servers Gate reserves the right to remove files which do not adhere to our terms of service, local, state, or federal laws.
Authorization of Charges
Servers Gate will bill clients for all services rendered and invoices are due within seven (7) days from the invoice date unless otherwise stated. The client authorizes Servers Gate to charge the payment method provided and stored within our billing system for any outstanding invoices, recurring services, renewals, add-ons, or other applicable charges. Alternative payment methods including PayPal, bank transfer, check, or money order may also be accepted at our discretion.

Servers Gate reserves the right to suspend, restrict, or terminate services for failure to make payment of initial setup fees, recurring charges, renewal invoices, or any other outstanding balances. Servers Gate further reserves the right to refuse, suspend, or cancel services pending receipt of valid payment or verification of billing information.
By signing up for our web hosting services, the client agrees to recurring automatic renewal payments using the selected payment method. Hosting plans and related services will automatically renew at the end of each billing cycle unless canceled by the client before the renewal due date. Applicable renewal fees will be automatically charged to the payment method on file.
It is the client’s responsibility to maintain valid and up-to-date billing and payment information at all times. Failure to process payment successfully may result in account suspension, service interruption, or permanent termination.
All automatic renewal charges and processed payments are final and non-refundable once billed or processed, except where required by applicable law or explicitly stated otherwise in our refund policy.
